1. Acceptance of Terms
By accessing or using the Sociara platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.
2. Description of Service
Sociara is a clinical consultation platform that facilitates virtual and in-person healthcare encounters between patients and healthcare providers. The Service includes patient intake, appointment scheduling, AI-assisted consultations, and secure messaging.
3. Eligibility
You must be at least 18 years of age (or the age of majority in your province or territory) to use this Service. By using Sociara, you represent that you meet this requirement.
4. Account Registration
To access certain features, you must create an account. You agree to provide accurate and complete information during registration and to keep your account credentials secure. You are responsible for all activity under your account.
5. Patient Health Information
The Service processes personal health information ("PHI") as defined under the Personal Information Protection Act (PIPA), the Personal Information Protection and Electronic Documents Act (PIPEDA), and the Health Insurance Portability and Accountability Act (HIPAA). All PHI is encrypted at rest using AES-256-GCM and in transit using TLS 1.2+.
PHI is stored exclusively in AWS ca-west-1 (Calgary, Canada) and never leaves Canadian infrastructure. See our Privacy Policy for full details on how your data is collected, used, and protected.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws
- Attempt to gain unauthorized access to the Service, other accounts, or any computer systems
- Interfere with or disrupt the integrity or performance of the Service
- Share your account credentials with any third party
- Use the Service to transmit any harmful, offensive, or inappropriate content
7. AI-Assisted Features
Sociara uses AI tools to assist healthcare providers with clinical note-taking, summarization, and communication. AI features are assistive only and do not replace the clinical judgment of your healthcare provider. Participation in AI-assisted features is optional and governed by a separate AI Consent Policy.
8. Disclaimer of Medical Advice
The Service is a communication and documentation platform. It does not provide medical diagnoses, treatment recommendations, or medical advice. Always consult a qualified healthcare provider for medical decisions. In a medical emergency, call 911 or your local emergency number immediately.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Sociara and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
10. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms or for any reason at our discretion. Upon termination, your right to use the Service ceases immediately, though your PHI will be retained as required by applicable healthcare regulations.
11. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via the email associated with your account. Continued use of the Service after changes constitutes acceptance.
12. Governing Law
These Terms are governed by the laws of the Province of British Columbia, Canada, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of British Columbia.
